NEMA is developing the first emergency management rule this year under the Emergency Management Bill (No 2) 2025 (EM Bill), relating to making declarations for states of emergency and transition periods. Under the Bill the current regulations which set out declaration forms will be revoked and the forms will instead be set out in emergency management rules which are issued by the Minister – this makes them easier to amend if needed.

From 1 May to 29 May 2026, the National Emergency Management Agency (NEMA) invites comment on the draft rule: Emergency Management Rule 1: Forms for declarations of states of emergency and transition periods. This rule will come into force when the EM Bill (if passed) takes effect later this year (the day after Royal assent) to allow for declarations to be made under the new Act.

We need to work on this now before the Bill is passed so that it is ready to go when the new legislation comes into force. 

Please note, the EM Bill is still subject to the Parliamentary process and feedback is sought only in relation to this proposed rule.

  • The parameters we are proposing around using electronic signatures 
  • The new forms provided for declaring different types of extensions (to states of emergency and transition periods) in the draft rule.
